Suspension du Gabon à l’ITIE : des propositions de la société civile pour éviter l’exclusion

Dans une lettre ouverte adressée au Président de la Transition, Chef de l’Etat, le général, Brice Clotaire Oligui Nguema, le collège de la Société civile, membre du Groupe Multipartite de l’ITIE-Gabon, a, décliné des propositions pertinentes pour éviter que le Gabon soit à nouveau exclu de cette initiative de bonne gouvernance. Lecture :

« Monsieur le Président de la Transition, alors que notre pays a reçu le 10 octobre 2023, la notification de la décision n°2023-36 du Conseil d’Administration de l’Initiative pour la Transparence dans les Industries Extractives (ITIE) dans laquelle il est mentionné ce qui suit : « Suite à la prise de pouvoir par les militaires au Gabon, le Conseil d’Administration a décidé que le Gabon fera l’objet d’une surveillance active pendant une période de trois mois, se terminant le 9 janvier 2024. Le Conseil d’administration a chargé le Secrétariat International de suivre de près l’engagement et les progrès du Gabon en matière d’adhésion aux Principes et Exigences de l’ITIE. S’il devient manifestement clair que des aspects importants des Principes et Exigences de l’ITIE ne sont pas respectés à la fin de la période de surveillance, le Conseil d’administration envisagera de suspendre le Gabon conformément à l’article 8.2 de Section 1 de la Partie 2 de la Norme ITIE 2023 », certains acteurs nationaux de la mise en œuvre de l’ITIE et en particulier le Groupe MultiPartite de l’ITIE-Gabon tardent à saisir l’urgence du moment.

Il est bon de savoir qu’il s’agit d’une condamnation de principe correspondant à la suspension d’un pays pour cause d’instabilité politique ou de conflit prévue à l’article 8.2 de la norme ITIE dans son volet « suivi de la mise en œuvre de l’ITIE par le Conseil d’Administration ». Toutefois, les faibles progrès enregistrés par notre Gabon au sujet de la mise en œuvre des exigences de la norme ITIE, devraient préoccuper ces acteurs, d’où le caractère renforcé d’ici la fin de la période de surveillance par la clause de suspension pour cause de non-respect des principes et exigences de l’ITIE, dont seules les informations issues d’une évaluation, permettront ou non de suspendre le Gabon.

Dans cette dynamique, le collège de la société civile au Groupe Multipartite de l’ITIE-Gabon vous assure de son soutien total et se tient à vos côtés pour donner forme à l’ambition de la gestion durable et responsable des richesses dérivées des ressources extractives afin qu’elle bénéficie aux citoyens. Pour conforter cette idée, nous n’avons pas attendu la décision du Conseil d’Administration de l’ITIE pour entreprendre un plaidoyer de haut niveau en s’adressant à vous-même puis aux autres parties prenantes de l’ITIE au Gabon (Ministre de tutelle, Ministres sectoriels, partenaires au développement), dans le respect des dispositions du protocole de la participation de la société civile, présenté aux pages 45 à 48 de la norme ITIE 2019.

Monsieur le Président de la Transition, depuis le retour du Gabon à l’ITIE, officialisé le 21 Octobre 2021 par le Conseil d’Administration de l’ITIE, la mise en œuvre de la norme ITIE 2019 se heurte à divers défis conjoncturels et structurels n’ayant malheureusement pas fait l’objet de solutions pérennes. Ces défis majeurs sont (1) la gouvernance chaotique et approximative

du Groupe Multipartite, (2) le faible engagement opérationnel de l’Etat ainsi que celui de certaines parties prenantes dont l’administration publique et certaines sociétés extractives privées et publiques, (3) les retards de mise à disposition des budgets nécessaires à l’exécution des plans d’actions annuels et (4) l’absence de développement organisationnel de l’ITIE-Gabon et de leadership politique de sa Présidente.

Il apparait donc que l’inaction et les nombreuses hésitations occasionnées par les acteurs de la mise en œuvre de l’ITIE au Gabon en général et du Groupe Multipatite en particpulier ont été les principaux vecteurs de la situation actuelle de l’ITIE-Gabon caractérisée par un management très approximatif à l’origine d’une faible performance organisationnelle et d’une absence de résultats attendus alignés sur la planification des plans d’actions annuels. Il est grand temps d’agir en passant de l’inaction à l’action pour renouer avec la confiance des communautés impactées par les activités des sociétés extractives, rassurer les partenaires au développement et partenaires internationaux de l’ITIE sur la matérialisation des intentions de l’Etat gabonais.

Pour vous y aider, le collège de la société civile au Groupe Multipartite de l’ITIE-Gabon a proposé en page 5 sur 6 de sa note de position datant du 17/09/2023 et ayant servi de plaidoyer au niveau national et international, et dont vous avez réçu copie, les recommandations clés suivantes, (1) la confirmation de l’engagement du Gabon au sein de l’ITIE par une lettre officielle du Président de la Transition, (2) la désignation d’un nouveau Président du Groupe MultiPartite de l’ITIE-Gabon, (3) le renouvellement de certains membres du collège de l’administration publique impactés par les nominations du Conseil des Ministres du 28 septembre 2023, (4) la tenue d’une session du Groupe Multipartite de l’ITIE-Gabon, (5) la révision du décret 0077 de l’ITIE-Gabon, (6) la mise à disposition du budget pour le financement du plan de travail annuel 2023, (7) la dissémination du rapport 2021 au niveau national et (8) la finalisation et publication du rapport ITIE 2022.

Monsieur le Président de la Transition, des options de conduite des politiques publiques plus vertueuses sur la manière la plus opportune de gérer la richesse liée aux ressources extractives, les tranformant en prospérité durable existent. Elles peuvent se concrétiser que si vous prenez la chaîne de décisions de politiques appropriées avec le soutien de tous et sous la supervision des citoyens. Or l’idéal d’une gouvernance responsable est à portée de main car notre pays a tant bien que mal réussi à tenir le premier engagement du Conseil d’Administration de l’ITIE consistant à publier le rapport ITIE de l’année 2021, 18 mois après l’adhésion du pays et rendu effective le 21 avril 2023.
