L’accusation n’est pas nouvelle, mais elle revient en boucle : pour une large frange de l’opinion publique, le pouvoir politique agit toujours avec «amateurisme», en marge de toute considération éthique ou juridique et, en comptant sur ses liaisons incestueuses. Publiée mercredi, la liste des participants à la concertation politique alimente la controverse. Dans la forme, elle accrédite l’idée d’un traitement différencié au gré de l’appartenance partisane. Dans le fond, elle consacre la confusion de notions connues de tous, jetant la suspicion sur les agissements du gouvernement. Sur quels fondements juridiques, le ministre de l’Intérieur a-t-il composé les délégations de partis disposant de procédures internes ? Pourquoi les représentants de la majorité doivent-ils être désignés intuitu personae quand ceux de l’opposition le sont ès-qualité, au nom de leurs formations politique ? Depuis quand des partis représentés au gouvernement appartiennent-ils à l’opposition ? Pourquoi les chefs d’institutions, censées être au service de tous, doivent-ils se mêler à une joute d’essence partisane ?
L’opposition répond à une définition connue
L’immixtion du ministre de l’Intérieur dans le choix des délégués de l’opposition envoie un message simple : loin de nourrir une quelconque gêne, le gouvernement se satisfait plutôt des vices de procédure ayant émaillé le processus de renouvellement du bureau du Centre gabonais des élections (CGE). Campant dans cette étrange logique, il range le Rassemblement héritage et modernité (RHM), le Parti social-démocrate (PSD), l’Union et solidarité (US) et, le Front d’égalité républicaine (Fer) dans l’opposition. Or, le président du RHM occupe encore les fonctions de ministre de la Décentralisation, de la cohésion et du développement des territoires. Quant à ses homologues du PSD, de l’US et du Fer, ils étaient jusqu’à un passé très récent vice-président de la République pour l’un, ministre de l’Enseignement supérieur pour l’autre, le troisième n’ayant jamais caché son soutien à la majorité, comme en attestent ses prises de position à l’Assemblée nationale.
N’en déplaise au ministre de l’Intérieur, l’opposition répond à une définition connue partout dans le monde : «Ensemble des mouvements et partis qui s’opposent aux forces politiques détenant le pouvoir». Dans un régime représentatif, elle se compose de «l’ensemble des partis qui n’appartiennent pas à la majorité parlementaire ou à la coalition au pouvoir». En refusant d’en tenir compte, Lambert-Noël Matha a apporté une preuve supplémentaire de l’incapacité du gouvernement à se conformer aux fondamentaux d’une démocratie apaisée. Volontairement entretenue, cette confusion donne plus de relief aux connivences institutionnelles consacrées par sa liste. En acceptant d’y figurer, le chef du gouvernement, le haut-commissaire général de la République et, les présidents des chambres du Parlement ont privilégié leur appartenance partisane, reléguant leurs attributions républicaines au rang d’accessoire. En raison de son statut de magistrat, seule la présidente de la Cour constitutionnelle ne figure pas dans la délégation de la majorité.
Complot contre la démocratie
Ce tableau d’ensemble est de nature à renforcer la méfiance et à nourrir la défiance populaire vis-à-vis des institutions. Redoutant ce mélange des genres, de nombreux partis avaient pourtant appelé à la clarification, exigeant d’être fixés sur le format. Pressentant ces dérapages, certains ont déjà choisi de claquer la porte. Si d’autres ne se sont pas encore exprimés, rien de bon ne se profile à l’horizon. En tout cas, les jours à venir s’annoncent riches en rebondissements. Comme si le pouvoir politique était définitivement incapable de créer les conditions de la préservation de «l’intérêt supérieur de notre pays et de sa population». Comme si ses ténors ne pouvaient «transcender (les) divergences et opinions partisanes». Comme s’ils sont au service exclusif d’un camp et pas de la République, c’est-à-dire de la chose publique au sens propre du terme, du bien commun dans sa réalité et de l’intérêt général comme dans l’idéal.
Au train où vont les choses, cette concertation pourrait se terminer en queue de poisson. Très vite, elle pourrait se muer en un monologue entre la majorité et ses alliés, officiels ou officieux. Au-delà, elle pourrait apparaitre comme un complot ourdi par les institutions contre la démocratie et les intérêts du peuple. Comment croire au caractère impersonnel des futurs projets de textes quand les principaux ministres concernés par la question électorale ou les différents maillons de la procédure législative figurent dans une délégation partisane ? Ou quand le secrétaire général du Parti démocratique gabonais (PDG) trône en deuxième position dans une liste conduite par le Premier ministre et comprenant la présidente du Sénat et le président de l’Assemblée nationale ? En termes de cynisme ou de négation du principe de séparation des pouvoirs, on peut difficilement faire pire…
