Le gouvernement béninois a révoqué en Conseil des ministres ce mercredi 12 avril 2023, les Secrétaires exécutifs des communes de Houéyogbé, de Cotonou et de Sèmè-Podji.

Des Secrétaires exécutifs de mairies révoqués. Il s’agit de messieurs Moutawakilou Assan Aoudou de la mairie de Houéyogbé, Nestor Manonwomeh Bossou de la mairie de Cotonou et Patrice Lafia de la mairie de Sèmè-Podji. Selon le Conseil des ministres, « à la suite d’une mission de la Cellule de suivi et de contrôle de la gestion des communes, il leur est reproché des actes constitutifs de violation des règles de déontologie administrative, de l’orthodoxie financière, d’abus de pouvoir et/ou d’atteinte grave aux intérêts de la commune ».

« De façon spécifique, le Secrétaire exécutif de la commune de Houéyogbé, en dépit de l’avis contraire du Responsable des affaires administratives et financières, son collaborateur censé être le plus avisé sur le sujet, a maintenu hors les livres du Trésor public, des comptes de la commune au mépris des directives du ministre de l’Economie et des Finances ordonnant la clôture de ces comptes », informe le Conseil des ministres. « Il s’est en outre rendu coupable d’avoir autorisé, pour un montant de 9.071.500 FCFA, des opérations de décaissement sur les comptes tenus dans les livres de la CLCAM de Houéyogbé, en violation des dispositions de l’article 390 du code de l’administration territoriale qui habilite, seul, le trésorier communal pour effectuer les opérations de recettes et de dépenses de la commune. Un tel comportement traduit une volonté délibérée de passer outre l’orthodoxie financière », ajoute le Conseil des ministres.

En ce qui concerne le Secrétaire exécutif de la commune de Cotonou, informe la même source, « alors que le code des marchés publics définit clairement son niveau d’intervention et son rôle dans la chaîne de passation des marchés publics, il s’est immiscé, à une étape qui n’était en rien concernée par ses fonctions, dans la procédure de passation du marché relatif à la réhabilitation des installations du réseau d’éclairage public de la ville de Cotonou à l’occasion de la fête du 1er août 2022. »

Le Secrétaire exécutif de la commune de Cotonou en interférant dans les attributions de la Personne responsable des marchés publics, « il a outrepassé ses prérogatives par des recommandations et/ou instructions, lesquelles ont prévalu dans l’attribution du marché à un prestataire à un coût plus onéreux pour la commune ». Il lui est aussi reproché « d’avoir approuvé un marché d’acquisition de véhicules au profit des services de la mairie, des responsables et du Trésorier communal, en violation de la réglementation sur la gestion du parc des véhicules et autres équipements motorisés de l’Etat ».

Quant au Secrétaire exécutif de la commune de Sèmè-Podji, « il est mis à sa charge le fait d’avoir approuvé, pour un montant de 54.280.000 FCFA TTC, un contrat de marché pour lequel les crédits nécessaires n’étaient pas prévus au budget de la commune et ce, en dépit des dispositions du code des marchés publics qui font expressément de l’absence ou de l’insuffisance de crédit, un motif de refus d’approbation des marchés ». Ce faisant, indique le Conseil des ministres, « il a engagé la commune dans l’exécution d’une dépense malgré l’absence de ressources ».

« Il est par ailleurs responsable de l’approbation de sept (07) contrats de marchés sans le visa du contrôleur financier alors que dans l’organisation de la chaîne de passation des marchés publics et, conformément à la règlementation, l’intervention du contrôle financier, vise à faire une vérification portant notamment sur la disponibilité de crédit et l’imputation de la dépense. Cette précaution est fondée sur la nécessité de prémunir l’autorité approbatrice des erreurs de gestion et de préserver les ressources publiques », souligne le Conseil des ministres.

Le gouvernement béninois rappelle que « l’objectif majeur de la réforme structurelle du secteur de la décentralisation, en mettant des cadres qualifiés à la disposition de nos communes, est de promouvoir la bonne gouvernance aux fins de favoriser la satisfaction des besoins des populations tout en améliorant leur bien-être ».

« Le ministre de la Décentralisation et de la Gouvernance Locale prendra les dispositions nécessaires pour pourvoir au remplacement des secrétaires exécutifs défaillants, conformément aux textes en vigueur, en relation avec la Cellule de suivi et de contrôle de la gestion des communes », précise le Conseil des ministres.
